
The China National Intellectual Property Administration (CNIPA) has formulated the 'Key Issues Q&A Concerning Evidence in Trademark Review of Refusal Cases' to address focal points in trademark review of refusal practice. This publication clarifies the form, types, and substantive requirements for evidence submission by applicants under specific circumstances, thereby assisting and guiding applicants in providing valid supporting documentation.
The Q&A addresses 29 principal issues, covering not only usage evidence but also scenarios such as applications for trademarks similar to foreign country names, applications for abbreviated enterprise names containing 'China', and applications for trademarks identical to martyrs' names, thereby encompassing multiple facets of review practice.
