OFFICIAL INTERPRETATION OF THE NOTICE ON STRENGTHENING THE MANAGEMENT OF TRADEMARK USE ISSUED BY THE CHINA NATIONAL INTELLECTUAL PROPERTY ADMINISTRATION



The China National Intellectual Property Administration (CNIPA) has recently issued the Notice on Strengthening the Management of Trademark Use, aiming to guide society in the proper use of trademarks and uphold a fair competitive market order. To safeguard the interests of consumers and business operators, the Notice focuses on seven categories of illegal and non-compliant trademark usage practices, including use of unregistered trademarks that are prohibited due to being deceptive or otherwise improper, deceptive use and impersonation of registered trademarks, failure to use a registered trademark where required, prominent use of 'Well-Known Trademark' in commercial activities and so on.

The Notice also puts forward six specific work measures—improving working mechanisms, carrying out key investigations, promptly handling clues, strengthening compliance guidance, enhancing comprehensive governance, and fostering a positive atmosphere—to ensure effective implementation of all tasks, promote the establishment of a sound order for the lawful and compliant use of trademarks, and effectively safeguard the interests of the public.
